Our Founder appeared for the Claimant which is a minority shareholder in the Defendant No.1. The case was regarding prayers for granting permission to commence derivative claim as the Claimant believed that the overall acts of commission & omission by the Defendant No.2, who is the majority shareholder in Defendant no.1 is harmful for the Defendant No.1.
H.E. Deputy Chief Justice Ali Al Madhani after adducing the evidence was pleased to pass an order allowing the permission to commence derivative claim after hearing both the parties. The permission to appeal has also been rejected.
The Court has mentioned categorically that the action for derivative claim has a high chance of success.
